Terms of Service

Welcome to Hobby Stall. By accessing or using the platform — whether as a seller, buyer, or visitor — you agree to these Terms of Service (“Terms”). Please read them carefully.

1. Marketplace Role

Hobby Stall provides online venue and software services that allow users to connect and conduct transactions. Hobby Stall is not a party to transactions between users unless expressly stated otherwise in writing. Hobby Stall does not take title to, possess, manufacture, inspect, warehouse, label, certify, or control user-listed goods, and does not guarantee that any listing, seller, buyer, or item complies with applicable law or platform policy.

2. User Responsibility for Compliance

Each user is solely responsible for that user's conduct, listings, products, statements, packaging, labeling, warnings, pricing, taxes, shipping practices, refunds, permits, registrations, recalls, and compliance with all applicable laws, rules, and regulations. Without limitation, sellers are solely responsible for complying with laws relating to:

• cottage food and food safety
• consumer product safety
• product restrictions and recalls
• hazardous materials
• age-restricted items
• export controls and sanctions
• privacy and data protection
• intellectual property
• consumer protection

3. No Legal Approval or Monitoring

Hobby Stall does not provide legal, regulatory, tax, labeling, shipping, or licensing advice. Any category guidance, examples, help content, or product prompts made available on the platform are provided for general informational purposes only and do not constitute approval, authorization, certification, or a determination that any listing is lawful or appropriate.

4. Right to Remove and Suspend

Hobby Stall may, at any time and without prior notice, take any of the following actions if it believes, in its sole discretion, that a listing or user may violate the Terms, the Prohibited Items Policy, applicable law, payment processor rules, shipping restrictions, or the rights, safety, or interests of others:

• remove or disable access to any listing;
• refuse to publish content;
• delay or cancel a transaction;
• require additional information from the user;
• restrict account features; or
• suspend or terminate an account.

5. Prohibited Items

Sellers may not list, advertise, offer, request, facilitate, or sell any product or service prohibited by the Hobby Stall Prohibited Items Policy, whether the item is illegal everywhere or only restricted in a particular jurisdiction, shipping lane, or payment channel. Hobby Stall may interpret and apply the Prohibited Items Policy in its sole discretion and may update the policy from time to time.

6. Buyer Terms

Buyers transact directly with individual sellers. Hobby Stall is not a party to any purchase and does not facilitate, hold, process, or escrow payments. Payments are made directly between buyer and seller outside of Hobby Stall via third-party services (such as Venmo or Cash App). Hobby Stall does not facilitate refunds and is not responsible for resolving disputes between buyers and sellers — dispute resolution is the sole responsibility of the buyer and seller involved.

Buyers are responsible for evaluating listings and making their own purchasing decisions. Hobby Stall does not guarantee the legality, safety, quality, authenticity, labeling, condition, or suitability of any item offered by a seller.

7. Indemnification

The user will defend, indemnify, and hold harmless Hobby Stall and its affiliates, officers, directors, employees, contractors, and agents from and against any claim, demand, action, investigation, loss, damage, fine, penalty, liability, cost, or expense, including reasonable attorneys' fees, arising out of or relating to:

1. the user's listings, goods, services, or transactions;
2. the user's breach of the Terms or any platform policy;
3. the user's violation of law or third-party rights; or
4. bodily injury, illness, death, property damage, or other harm allegedly caused by the user's products, packaging, labeling, or conduct.

9. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Illinois, United States, without regard to its conflict of law principles. Hobby Stall and the user agree to first attempt to resolve any dispute informally by contacting legal@hobbystall.com. If a dispute cannot be resolved informally within 30 days, both parties agree to resolve it through binding individual arbitration administered in Illinois, United States.

You and Hobby Stall waive the right to a jury trial and the right to participate in any class action or class-wide arbitration.

10. Termination

Either party may terminate their use of the platform at any time. Upon termination, sellers may request an export of their shop data within 30 days of account closure by emailing legal@hobbystall.com. Hobby Stall retains transaction records and other data as required by law, including for tax and legal compliance purposes.

11. DMCA / Intellectual Property Claims

Hobby Stall respects intellectual property rights. To submit a DMCA takedown notice, send a written notice to legal@hobbystall.com that includes:

1. Identification of the copyrighted work claimed to have been infringed.
2. Identification of the material you claim is infringing, with enough detail for us to locate it.
3. Your contact information (name, address, phone, email).
4. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or law.
5. A statement under penalty of perjury that the information in the notification is accurate and that you are the copyright owner or authorized to act on their behalf.
6. Your physical or electronic signature.

12. Changes to These Terms

Hobby Stall may update these Terms from time to time. When we make material changes, we will update the version date at the top of this page and notify sellers in-app. Continued use of the platform after notice constitutes acceptance of the updated Terms. Sellers will be prompted to re-accept on next login following any material change.
